General functions under Officer-in-Charge

  • Generally deals with law matters related to Criminal Cases, Violation of Human Rights, Essential Commodity Act, Arms Act etc.
  • Engagement of Assistant Public Prosecutor through Public Prosecutor to defend the State Govt. in all sorts of Trial, Appeal, Criminal Revision in various Courts of Howrah district.
  • Engagement of State Advocate through the Legal Remembrancer to defend the District Magistrate in Writ Petition filed in the High Court, Calcutta.
  • Vesting powers U/S 133 and Sec 144 of the Criminal Procedure Code, 1973 of Executive Magistrate to newly posted Dy. Magistrate & Dy. Collector in the District to discharge function of Executive Magistrate in maintaining law and order.
  • Engagement of Executive Magistrate in disposal of unclaimed property lying at Malkhana of Police Stations under the jurisdiction of this district.
  • Engagement of Executive Magistrate in maintaining law and order and inquest matter.
  • Engagement of Sanction order U/S 39 of the Arms Act, 1959 for Prosecution of accused U/S 25(1-b) (a) and U/S 27 of Arms Act, 1959 as received from the different Police Stations under the jurisdiction of this district.
  • Cause enquiry in the matter relating to Police Firing held within the jurisdiction of this district.
  • Issue of Certificate for exemption of Excise Duty in respect of G.I Pipe of different diameter as notified by the Finance Deptt. Govt India to be used in different Water Supply Scheme undertaken by the State Govt. / Local Bodies etc.
  • Cause enquiry in case of Custodial Death and send report to the National Human Rights Commission (NHRC) and West Bengal Human Rights Commission (WBHRC). Payment of compensation to the victim on violation of human rights as awarded by the NHRC and WBHRC from time to time.
  • Correctional Home (Jail) matters
  • Matter related to withdrawal of Cases u/s 321 of Cr.P.C
  • Matter related to Child Rape Case
  • Payment of professional fees to Ld Public Prosecutor, Govt Panelled Assistant Public Prosecutor of the Howrah District
  • Payment of Charges of carrying dead bodies post mortem, diet charges of inmates of police custody.
  • Payment of Electricity Bill of Howrah Police Morgue

Other Duties

  • Matters relating to Registration of News Paper / Magazines / Periodicals
  • Low Income Group Housing (LIGH) release of mortgage deed that are provided loan under LIGH Scheme.
  •   Complaint received from public on violation of Human Rights
Types of complaints which are enquired and disposed of from this office:-

  • Compliant on violation of Human Rights received from individual against any individual.
  • Compliant on violation of Human Rights received from National and State Human Rights Body.
  • Payment of compensation to the victims as awarded by the National and State Human Rights Body from time to time have been given after proper enquiry by this end.
  • Custodial Death / Death of Under Trial / Convicted Prisoners under custody as occurred within the jurisdiction of this district has been enquired into as per strict standard protocol and guidelines formulated by the  National Human Rights Commission
  • Documents pertaining to death of Under Trial / Convicted Prisoners under custody as directed by the   National Human Rights Commission are sent after procuring it from the different end.


  • All RTI related application received through D.M. Confidential section and place to SPIO for necessary action, if possible copy of relevant documents handed over to the applicant by the fees as admissible and if not possible others sent to the concerned department for necessary action within the time limit.
  • Engagement of Issue and renewal of Money Lending cases.
  • Appointment and transfer cases of Stamp Vendor in this District.
  • All Departmental Proceeding Cases.

Functions under an  ADM-in-Charge :

  • Land & Land Reforms Department is one of the oldest departments of the state as well as of the country.
  • The principal work of this department is the implementation of various Land  Reforms Acts especially West  Bengal  Estates  Acquisition  Act, 1953  and  the West Bengal Land Reforms Act, 1955.
  • The activities of this department have tremendous social implications and have an  important role in reducing disparities in the socio-economic structure of the agrarian society of this state.
  • Under the changed scenario, this department has also  beenoneof  the  keen  pins  of  socio  economic  development, industrial  growth and modernization  on  one  hand while  harnessing  indiscriminate  changes  in  land  utilization pattern.
  • The District Land & Land Reforms Officer, having the powers of Collector, heads the Integrated  Set up of Land & Land Reforms Administration in the district. In a district the entire structure consists of four tiers extended up to Gram panchayet level at the lowest.
  • This  office  has five sections viz  Establishment  &  Nazarath,  Serestha,  Law  cell, Drawing  Section  and  Computer  Section.
  • The  Establishment  Section  deals  with  all  the establishment related matter pertaining to leave, transfer and posting of officers and staff and their service matters & also the function of D.D.O.
  • The Law cell deals with various court cases relating to LR and appeals under WBLR Act. It also handles vesting and divesting cases.
  • The  Sarestha  Section  deals with  lease  and  license,  collection  of Land  Revenue  & Royalty,   Report   &  Returns,   Conversion   Miscellaneous   issues   like  Public   grievance, Assembly  questions,  Audit  matters  etc.
  • The technical  adviser  is the head  of the drawing Section which deals with inking of L.R. maps and despatch of sheets to the W.B.D.O. The Computer  Section deals with computerized  land records including all kinds of report and return.

Recruitment to Group – ‘C’ staffs in different District Judgeship, which provides the constitution of the District Recruitment Committee and the Recruitment Committee for City Civil Courts and the Recruitment Cell to be established in each District Court and the City Civil Court. The recruitment Cell was entrusted to frame a guidelines for the Recruitment Committee including processing the applications received for the post and short-listing them and such recruitment should take place every year well in advance before the vacancy arise.

Sub: Admissibility of Domestic Help Allowances to the retired Judicial Officers of the West Bengal Judicial Service.

I am directed to say that the Governor has been pleased to allow all retired Judicial Officers of the West Bengal Judicial Service including retired members of the erstwhile West Bengal Civil Service (Judicial) and the West Bengal Higher Judicial Service will be entitled to draw
Domestic Help Allowances @Rs.1250/- per month in cash w.e.f. 01.11.1999. Such allowances shall be included in the revised P.P.O. of the pensioner concerned and the payment shall be made on the basis of a certificate to be issued by the pensioner himself/herself to the satisfaction of the disbursing authority of the pensioner benefit.

This order is issued in compliance with the directions of the Hon’ble Supreme Court of India dated 06-12-2005 read with order dated 07-02-2006 passed in Writ Petition (Civil) No.1022 of 1989 and with the concurrence of the Finance Department vide their U.O. No.1095 Group ‘P’ (Service) dt. 16.03.2006.

Criminal Justice 

Public Prosecutors ( Session Court)
The Public Prosecutor conducts criminal cases on behalf of the Government of west Bengal in the session court. The cases handled by the Public Prosecutor are of grave in nature and exclusively trailed by the Session Court. Also appears in the appeals and revision against the order of the lower Courts. At present five advocates are appointed and appearing in the Sessions court for conducting the criminal cases on case wise fees payable on their appearance basis.

Assistant Public Prosecutor[ Government Cadre]

His main function is to conduct Criminal cases in the Court of Chief Judicial Magistrate/ Judicial Magistrate First Class. In addition to the case filed by the Police, he also deals with the criminal cases of other Department such as Food and Drugs, Labour Department, Excise Department, Forest Department, Town and County Planning Department of the Administration.
