Title of affidavits—Every affidavit shall be in Form VII, titled as “………………….” followed by the cause title of the application or other proceeding in which the affidavit is sought to be used.
Form and contents of the affidavit—The affidavit shall conform to the requirements of order XIX, rule 3 of the Code of Civil Procedure, 1908 (5 of 1908).
Persons authorized to attest—Affidavits shall be in Form VIII sworn or affirmed before any Judicial Magistrate or Civil Judge or Notary or District Registrar or Sub-Registrar, who shall affix his official seal.
Affidavits of illiterate, blind persons—Where an affidavit is sworn or affirmed by any person who appears to be illiterate, blind or unacquainted with die language in which the affidavit is written, the attestor shall certify that die affidavit was read, explained or translated by him or in his presence to die deponent and that he seemed to understand it, and made his signature or mark in the presence of the attestor.
Identification of deponent—If the deponent is not known to the attestor, his identity shall be testified by a person known to him and the person identifying shall affix his signature in token thereof
Annexures to the affidavit—Documents accompanying an affidavit shall be referred to therein as Annexures and the deponent shall make endorsements thereon identifying and numbering the documents and the attestor shall also attest the endorsements.
