Definition of ‘dependant’ as provided in Section 2(1)(d) of Act, 1923, which is reproduced herein below:-
(d) “dependant” means any of the following relatives of a deceased (employee), namely-
(1) a widow, a minor [legitimate or adopted] son, an unmarried [legitimate or adopted] daughter, or a widowed mother; and
(2) if wholly dependent on the earnings of the [employee] at the timeTime Where any expression of it occurs in any Rules, or any judgment, order or direction, and whenever the doing or not doing of anything at a certain time of the day or night or during a certain part of the day or night has an effect in law, that time is, unless it is otherwise specifically stated, held to be standard time as used in a particular country or state. (In Physics, time and Space never exist actually-“quantum entanglement”) of his death, a son of a daughter who has attained the age of the 18 years and who is infirm:
(3) if wholly or in part dependent on the earnings of the [employee] at the time of his death-
(a) a widower.
(b) a parent other than a widowed mother.
(c) a minor illegitimate son, an unmarried illegitimate daughter or a daughter [legitimate or illegitimate or adopted] if married and a minor or if widowed and a minor.
(d) a minor brother or an unmarried sister or a widowed sister if a minor.
(e) a widowed daughter-in-law.
(f) a minor child of a pre-deceased son.
(g) a minor child of a pre-deceased daughter where no parent of the child is alive, or
(h) a paternal grandparent if no parent of the [employee] is alive;
