Justice is a principle which regulates the distribution of things, valued by men awarding them to some, denying them to others. It is, at the same time, a principle whereby each man’s worth is appraised. Justice gives to “every one that which is his.” It is not a free gift from the Court.

What, then, is the meaning of the expression ‘in the interests of justice’? It must mean, I think, to promote or advance the cause of justice. Justice may be defined in various ways and has been so diversely defined through centuries of legal evolution. Leaving aside Plato’s idea of justice as based on the differentiation of citizens according to status and capacities.

This is because religion has to do with gods and devils; because it presumes to tell man of his place in and relation to the world and the whence and whither of his being; because it teaches the necessity of holding certain beliefs regarding these things, and because it appeals fundamentally to man’s emotions—to his hope for happiness and fear of pain in another world.

While under our Constitution and form of government the great mass of local matters is controlled by local authorities, the United States, in their relation to foreign countries and their subjects or citizens, are one nation, invested with the powers which belong to independent nations, the exercise of which can be invoked for the maintenance of its absolute independence and security throughout its entire territory.
