Amendment of By-Laws of a Co-operative Society
A Co-operative society registered under the WBCS Act, 2006 and Rules framed thereunder may apply.
Relevant Section of WBCS Act & Rules:-
- Relevant provision in the WBCS Act, 2006: Section – 19, 20
- Relevant provision in the WBCS Rules, 2011: Rule – 12 & FORM VIII, 13
For registration of amendment of by-laws a Co-operative Society may by resolution in general meeting adopted by two-thirds of the members or delegates or representatives present but not less than one-third of the total number of members or delegates or representatives as on the register of members, or delegates or representatives on the date of issue of notice of such general meeting amend its by Laws, may apply before the Registrar with Form VIII by registered post or by hand to the Registrar within a period of sixty days from the date of adoption of resolution.
Every application with Form VIII forwarded to the Registrar shall be signed by the chairman and two members of the board, duly authenticated by the Inspector of the co-operative societies and shall be accompanied by the following documents:-
(a) in case of partial amendment, three copies of statement showing the existing by-laws and the proposed amendment of by-laws and three copies of the resolution approving the amendment;
(b) in case of complete amendment by substitution of an entire set of by-laws, three copies of the new by-laws and existing by-laws and three copies of the resolution approving the substitution;
(c) notice issued for the general meeting in which the amendment was approved;
(d) attendance sheet of the general meeting.
