
A judge should discourage ex parte hearingsย of applications for injunctions and receivershipsย where the order may work detriment to absentย parties; he should act upon such ex parte applicationsย only where the necessity for quickย action is clearly shown; if this be demonstrated,ย then he should endeavor to counteract the effectย of the absence of opposing counsel by a scrupulousย cross-examination and investigation as toย the facts and the principles of law on which theย application is based, granting relief only whenย fully satisfied that the law permits it and theย emergency demands it. He should rememberย that an injunction is a limitation upon the freedomย of action of defendants and should not beย granted lightly or inadvisedly.
