In regard to third question, we hold that Sections 125 to 128 of the Code are not applicable after coming into force of the [Muslim Women (Protection of Rights on Divorce) Act, 1986], save in so far as the parties exercise their option under Section 5 of the Act, to be governed by the provisions of Sections 125 to 128 of the Code.

A brief reference may be made to the decision in Abdul Gafoor v. A.U. Pathumma Beevi, 1989 Crl. L.J. 1224. It is held that a divorced Muslim woman is not entitled to invoke Section 127 of the Code for seeking enhancement of maintenance after 19th May 1986, the date on which Muslim Women (Protection of Rights on Divorce) Act, 1986 came into force. The Court further held that even though Sections 125 to 127 of the Code of Criminal Procedure have not been repealed by the Act of 1986, it cannot be said that the Act of 1986 supplemented, widened or enriched the contents of rights ensuring to the wife under the Code. The Act of 1986 being in the nature of a special law which applies to the Muslim community, it excludes the operation of Sections 125 to 128 of the Code in so far as that community is concerned.
