Domestic Violence Act of South Africa (1998)

Replaces the Prevention of Family Violence Act, 1993. The Act comprises a substantial broadening of the limited scope of the 1993 - Act, and recognises that domestic violence is a serious social evil and an obstacle to achieving gender equality. The Act offers protection to any victim of domestic violence who is in a domestic relationship with an abuser. A broad definition has been given to "domestic violence", so as to include any form of abuse and not only physical abuse. The Act places a duty on a member of the Police Service to inform a victim of his or her rights at the scene of the incident of domestic violence. Provision is also made for the National Commissioner of the South African Police Service to issue national guidelines which must be observed when dealing with domestic violence, and failure to comply with these guidelines will result in disciplinary proceedings against the member concerned.

What is Domestic Violence?

According to the Domestic Violence Act No. 116 of 1998 it is:

any form of abuse which includes physical, sexual, emotional, psychological or economic harassment
damage to property
stalking
entry into a person’s property without their consent
any other abusive or controlling behaviour where such a conduct causes harm or may cause harm to your health, safety, or well being
If these forms of abuse are happening to you or to anyone you know, you can apply for a protection order. A domestic violence protection order is a document issued by the court which prevents the abuser from:

  • committing an act of domestic violence
  • enlisting the help of another person to commit any such act
  • entering a residence shared by the complainant and the respondent
  • entering a specified part of such a shared residence
  • entering the complainantโ€™s residence
  • entering the complainantโ€™s place of employment
  • preventing the complainant who ordinarily lives or lived in a shared residence from entering or remaining in the shared residence or a specified part of the shared residence or
committing any other act as specified in the protection order.
