Religious offences under Pakistan Penal Code 1860

Whoever destroys, damages or defiles any place of worship, or any object held sacred by any class of persons with the intention of thereby insulting the religion of any class of persons or with the knowledge that any class of persons is likely to consider such destruction damage or defilement as an insult to their religion. shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

OF OFFENCES RELATING TO RELIGIONReligion ‘The word ( θρησκεία) -Re Legion (Latin)- A group or Collection or a brigade, is a social-cultural construction and substantially doesn’t exist. Catholic religion (संघवाद) is different from the Protestant religion (संघवाद). Dharma is not Religion (धार्मिक संगठन). "Religion" occurs 5 times in 5 verses in the KJV. Hindu Religion means in the indian language is हिंदू धार्मिक संगठन. Deen in Islam.

295. Injuring or defiling place of worship, with Intent to insult the religion of any class:

Whoever destroys, damagesDamages Damages (often termed ‘user damage’) are readily awarded at common law for the invasion of rights to tangible moveable or immovable property (by detinue, conversion or trespass). Damages are also available on a similar basis for patent infringement and breaches of other intellectual property rights of a proprietary character. or defiles any place of worship, or any object held sacred by any class of persons with the intentionIntention This means to “have in mind.” A plant to do a thing (Planning: premeditation is evident through evidence of active preparation, e.g., hoarding pills, purchase of weapon). 295-A. Deliberate and malicious acts intended to outrage religious feelings of any class by insulting Its religion or religious beliefs:

295-B. Defiling, etc., of HolyHoly Hebrew root qdš makes the word qōdeš (distinct). "And you shall be to Me a kingdom of priests and a holy nation". (Exodus 19:6a).  Distinct, which is not common or ordinary. "Be holy, for I, the YAHA, your ELOHIM, am holy" (Lv 19.2; cf. 11.44; 20.26) > be just, pure, and clean. Greek ἅγιος is " set apart" and is different from Hebrew 'qodes'.καὶ τοῦ ἁγίου πνεύματος (Matt 28.19). 'the holy place' (מִקְדָּשׁ, Ezekiel 37:28). Sanskrit 'pavitra -पवित्र' means sanctified by vedic mantra and rituals and not only cleaned 'something' by clean water or by fire. Folly (Oppo). Qur’an:

Whoever wilfully defiles, damages or desecrates a copy of the Holy Qur’an or of an extract therefrom or uses it in any derogatory manner or for any unlawful purpose shall be punishable with imprisonment for life.

295-C. Use of derogatory remarks, etc., in respect of the Holy ProphetProphet Προφητεύω (Prophesy) - He who tells in advance. A prophet may not be a Messenger of God. He may simply predict something may happen in the future. Hebrew prophets claimed to be able to see the future or interpret the present situation for future circumstances. Narada in Indian Puranas was the Messenger from Devatas. Whether the 'future' exists or not is the investigative subject of Physics. Elohim never created any future for Adam in Genesis (1.1). Islam claims Muhammad as the last Abrahamic prophet.:

He migrated to Medina on 26th July 623 AD and established his deen,  Islam (5:3) Last wish of the Prophet: "Bring me pen and paper so that I may write something which shall always guide you and shall keep you on the Right Path and shall save you from being astray" (Saheeh Bukhari and Muslimin) Ahlul-Bayt of the Prophet: • Fatimah al-Zahra (daughter from mother Khadija, died after 90 days of her holy Father) • Imam ‘Ali, (cousin of Prophet, husband of Fatima, son of  Abu Talib and Fatima Bine Asad) • Imam al-Hasan-iban Ali, • Imam al-Husayn-Iban Ali, • Wives of the Prophet (peacePeace εἰρήνη be upon him) shall be punished with death, or imprisonment for life, and shall also be liable to fine.

296. Disturbing religious assembly:

Whoever voluntarily causes disturbance to any assembly lawfully engaged in the performance of religious worship, or religious ceremonies, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

297. Trespassing on burial places, etc.:

Whoever, with the intention of wounding the feelings of any person, or of insulting the religion of any person, or with the knowledge that the feelings of any person are likely to be wounded, or that the religion of any person is likely to be insulted thereby, commits any trespass in any place of worship or on any place of sculpture, or any place set apart for the performance of funeral rites or as a, depository for the remains of the dead, or offers any indignity to any humanHuman Ο άνθρωπος (Humanum> Homo sapiens) मानव:. We have failed to consider the minimum need to be a 'human'. For Christians, human beings are sinful creatures, who need some saviour. For Evolution biology a man is still evolving, for what, we don´t know. For Buddhist Nagarjuna, the realisation of having a human body is a mere mental illusion. We are not ready to accept that a human is a computer made of meat. For a slave master, a human person is another animal, his sons and daughters are his personal property.             corpse or causes disturbance to any persons assembled for the performance of funeral ceremonies, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

298. Uttering words, etc., with deliberate intent to wound religious feelings:

Whoever, with the deliberate intention of wounding the religious feelings of any person, utters any wordWord Λόγος  or makes any sound in the hearing of that person or makes any gesture in the sight of that person or places any object in the sight of that person, shall be punished with imprisonment of either description for a term which may extend to one year or with fine, or with both.

298-A. Use of derogatory remarks, etc., in respect of holy personages:

Whoever by words, either spoken or written, or by visible representation, or by any imputation, innuendo or insinuation, directly or indirectly, defiles the sacred name of any wife (Ummul Mumineen), or members of the family (Ahle-bait), of the Holy Prophet (peace be upon him), or any of the righteous Caliphs (Khulafa-e-Rashideen) or companions (Sahaaba) of the Holy Prophet (peace be upon him) shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.

298-B. Misuse of epithets, descriptions and titles, etc., reserved for certain holy personages or places:

(1) Any person of the Quadiani group or the Lahori group (who call themselves ‘Ahmadis’ or by any other name who by words, either spoken or written, or by visible representation-

(a) refers to or addresses, any person, other than a Caliph or companion of the Holy Prophet Muhammad (peace be upon him), as “Ameer-ul-Mumineen”, “Khalifatul- Mumineen”, Khalifa-tul-Muslimeen”, “Sahaabi” or “Razi AllahAllah The Holy god of Muhammad revealed the Quran to him. In pre-Islamic Arabian culture, he had two daughters. He is al-ilāh. Il, el, or Eloah (Elohim= King in Torah) are the Semitic names of Allah. Allah's tawḥīd, wāḥid and aḥad were revealed to his Rusul. Attributes: Oneness: Allah is unique and incomparable, and no deity is worthy of worship except Him. Creator and Sustainer: Allah is the creator of all things and has the power to sustain and nourish His creation. Compassionate and Merciful: Allah's mercy and compassion are boundless, as He forgives sins and gives without measure. All-Knowing: Allah has complete knowledge of the heavens and the earth and the secrets of hearts. Just and Wise: Allah is just and does not wrong anyone. His wisdom is evident in His creation and His divine plans. Listener and Answerer of Prayers: Allah listens to the distress of His servants and responds to their prayers. Final Judge and Ultimate Destination: All affairs ultimately return to Allah, and the outcome of all matters is with Him. Anho”;
(b) refers to, or addresses, any person, other than a wife of the Holy Prophet Muhammad (peace be upon him), as “Ummul-Mumineen”;
(c) refers to, or addresses, any person, other than a member of the family “Ahle-bait” of the Holy Prophet Muhammad (peace be upon him), as “Ahle-bait”; or
(d) refers to, or names, or calls, his place of worship a “Masjid”;
shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.

(2) Any person of the Qaudiani group or Lahori group (who call themselves “Ahmadis” or by any other name) who by words, either spoken or written, or by visible representation refers to the mode or form of call to prayers followed by his faithFaith  πίστει. as “Azan”, or recites Azan as used by the MuslimsMuslim A community gathered around Muhammad (d. 632 CE) and confessed that Muhammad was the last of Prophets and he received Quran through Zibreel Farista from Allah. Hadith of Sahih Bukhari faithfully recorded the commands of Muhammad. He acknowledged the contribution of Jesus to the Abrahamic Religion. Muslim Sect: Sunni, Twelver Shia, Ismā‘īlī Shī‘ī, Ahmadi, Ibadi, Ḥanafi, Shafi‘ī, Maliki, Hanbali, Wahhabi, Salafi, Deobandi, Barelvī, and so many., shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.

298-C. Person of Quadiani group, etc., calling himself a MuslimMuslim A community gathered around Muhammad (d. 632 CE) and confessed that Muhammad was the last of Prophets and he received Quran through Zibreel Farista from Allah. Hadith of Sahih Bukhari faithfully recorded the commands of Muhammad. He acknowledged the contribution of Jesus to the Abrahamic Religion. Muslim Sect: Sunni, Twelver Shia, Ismā‘īlī Shī‘ī, Ahmadi, Ibadi, Ḥanafi, Shafi‘ī, Maliki, Hanbali, Wahhabi, Salafi, Deobandi, Barelvī, and so many. or preaching or propagating his faith:

Any person of the Quadiani group or the Lahori group (who call themselves ‘Ahmadis’ or by any other name), who directly or indirectly, poses himself as a Muslim, or calls, or refers to, his faith as Islam, or preaches or propagates his faith, or invites others to accept his faith, by words, either spoken or written, or by visible representations, or in any manner whatsoever outrages the religious feelings of Muslims shall be punished with imprisonment of either description for a term which may extend to three years and shall also be liable to fine.
