In view of the directions issued by the Hon’ble High Court at Calcutta, vide its solemn Order dated 18.04.2023 in the Public Interest Litigation being WPA (P) 263 of 2021 in I.A. No. CAN 1 of 2021 (Pakuahat Social Welfare Society & Ors. vs. The State of West Bengal & Ors.), the Registrar of Assurances, Kolkata, and all District Registrars of West Bengal are hereby instructed as follows:
- All Registering Officers under their control must not accept for registration any document that purports or operates to create, declare, assign, limit, or extinguish—whether in present or in future—any right, title, or interest, whether vested or contingent, in immovable property falling under:
- the classification of “Hat” in any form, and/or
- any category of land classified as “Vested Land” under the law currently in force.
- All Registering Officers shall remain vigilant when any such document is presented for registration. Wherever necessary, they must consult and/or obtain the list of such classified lands from the office of the concerned Land Revenue Officer.
