In recent years, due to rapid urbanisation and socio-economic development, land prices across the State have risen significantly. Consequently, for lands settled on long-term leasesโtypically for 30 or 99 yearsโthe renewal fees, calculated on the basis of prevailing market valuation, have become substantial. This has discouraged many lessees from seeking timely renewal of their leases. Such delays adversely affect the revenue interests of the State.
Recognising the need to streamline the renewal processโbalancing the Stateโs revenue considerations with the financial capacity of lesseesโthe State Government has reviewed the existing framework. In pursuance of section 49 of the West Bengal Land Reforms Act, 1955 and rule 226 of Chapter XV of the West Bengal Land & Land Reforms Manual, 1991, the Government has considered suitable revisions in the rate of annual rent payable for the renewal of long-term leases of vested lands.
After careful examination, the Governor is pleased to introduce the following amendments to the West Bengal Land & Land Reforms Manual, 1991 (hereinafter referred to as โthe said Manualโ), specifying the revised annual rent for renewal of long-term leases:
Amendments
In the said Manual, in sub-rule (i) of rule 226โ
- For clause (a), substitute the following:(a)
- For Industrial, Agri-allied (Poultry, Goatery, Piggery, Duckery, Horticulture, etc.) and Institutional purposes:
30 times the earlier annual rent or 4% of the current market valuation, whichever is less, shall be the new annual rent for renewal. - For Commercial purposes:
50 times the earlier annual rent or 4% of the current market valuation, whichever is less, shall be the new annual rent for renewal.
โInstitutional useโ includes activities carried out by Government Organisations, Parastatals, Government Undertakings, Government-owned companies, and Government-aided educational institutions (excluding private educational institutions).
It also covers charitable organisations such as Ramakrishna Mission, Bharat Sevashram Sangha, Lions Club, Indian Red Cross Society, Rotary International, and registered clubs/organisations engaged in social welfare activities.
These categories are illustrative, not exhaustive. In case of any dispute, the State Governmentโs decision regarding institutional status at the time of renewal shall be final. - For Industrial, Agri-allied (Poultry, Goatery, Piggery, Duckery, Horticulture, etc.) and Institutional purposes:
- For clause (b), substitute the following:(b)
For Homestead or Residential purposes (other than Real Estate development):
15 times the previously payable annual rent or 4% of the prevailing market price at the time of renewal, whichever is less, shall be the new annual rent for renewal. - After clause (b), insert the following:(c)
For any other purposes:
50 times the previously payable annual rent or 4% of the market price at the time of renewal, whichever is less, shall be the new annual rent for renewal.
