Subject: Land Use Compatibility Certificate regarding conversion of land under Section 4C of the West Bengal Land Reforms Act, 1955.
Whereas the jurisdiction of the Collectors (DL&LRO / SDL&LRO / BL&LRO) in matters relating to conversion—i.e., change of area, character or use of land—under Section 4C of the West Bengal Land Reforms Act, 1955 is governed by this Department’s Notification No. 4296-LR/1A-05/07 GE(M), dated 17th September, 2009;
And whereas such conversion is required to be undertaken only after obtaining the necessary approval from the Urban Development & Municipal Affairs Department or the concerned municipal body for issuance of a Land Use Compatibility Certificate (LUCC), wherever applicable under Section 46 of the West Bengal Town & Country (Planning & Development) Act, 1979;
Now, therefore, it is hereby ordered that, before granting any conversion of land under Section 4C of the WBLR Act, 1955, the Collectors (DL&LRO / SDL&LRO / BL&LRO), within their respective jurisdictions, must seek and obtain official comments from the Urban Development & Municipal Affairs Department or the concerned municipal authority regarding the Land Use Compatibility Certificate (LUCC), wherever such certificate is required under Section 46 of the West Bengal Town & Country (Planning & Development) Act, 1979.
