Under Section 272 of the Code of Criminal Procedure, 1973 (for short โCrPCโ), the State Government has the power to determine what shall be, for the purposes of CrPC, the language of each Court within a particular State other than the High Court. Section 272 deals with only the language of the Courts under CrPC. Section 277 (b) permits a witness to give evidence in any other language which is not the language of the Court. It lays down the procedure for recording such evidence…The reason is that the accused must get a fair opportunity to defend himself. He must know and understand the material against him in the charge sheet. That is the essence of Article 21 of the Constitution of India.
