Govt mandated tracking system device for N2 & N3 vehicles carrying dangerous or hazardous goods manufactured after 01/07/2022

It has been brought to the notice of Ministry of Road Transport and Highways that vehicles, which are not under the ambit of national permit, carrying various gases viz Argon, Nitrogen, Oxygen etc. and goods of dangerous or hazardous nature, are not fitted with Vehicle Location Tracking Devices.

It has been brought to the notice of Ministry of Road Transport and Highways that vehicles, which are not under the ambit of national permit, carrying various gases viz Argon, Nitrogen, Oxygen etc. and goods of dangerous or hazardous nature, are not fitted with Vehicle Location Tracking Devices.

Accordingly, the Ministry, vide G.S.R 617(E) dated 3rd August, 2022, has mandated that every vehicle of categories N2 and N3, manufactured on and after the 1st Day of September, 2022, in the case of new models, and 1st day of January, 2023, in the case of existing models, carrying dangerous or hazardous goods, shall be fitted with a vehicle tracking system device as per AIS 140.

G.S.R. 617(E).โ€”Whereas, the draft of certain rules further to amend the Central Motor Vehicles
Rules, 1989 was published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R 127(E), dated the 15th February, 2022, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the official Gazette containing the said notification were made available to the public;

And whereas, copies of the said Gazette notification were made available to the public on the 15th February, 2022;

And whereas, objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;

Now, therefore, in exercise of the powers conferred by clauses (k) and (l) of sub-section (1) of section
110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-

1. (1) These rules may be called as Central Motor Vehicles (Eleventh Amendment) Rules, 2022.
    (2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989, in sub-rule (1) of rule 129, after clause (iv), the following
clause shall be inserted, namely:-

โ€œ(v) every vehicle of categories N2 and N3, manufactured on and after the 1st Day of September, 2022, in the case of new models, and 1st day of January, 2023, in the case of existing models, carrying dangerous or hazardous goods, shall be fitted with a vehicle tracking system device as per AIS 140.โ€

Explanation.- For the purpose of this clause, the expression,-

(a) โ€œexisting modelโ€ in respect of a vehicle of category N2 or category N3, means the vehicle in respect of which a type-approval certificate has been issued under section 110B of the Act, on or before the commencement of the Motor Vehicles (Eleventh Amendment) rules, 2022;

(b) โ€œnew modelโ€ in respect of a vehicle of category N2 or category N3, means the vehicle in respect of which a type-approval certificate has been issued under section 110B of the Act, after the commencement of the Motor Vehicles (Eleventh Amendment) rules, 2022.โ€.

Note: The principal rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), vide notification number G.S.R. 590(E), dated the 2nd June, 1989 and lastly amended vide notification number G.S.R. 479(E), dated the 28th June, 2022.
