Hunter Biden’s Pardon: Justice or Politics?

On December 1, 2024, President Joe Biden announced he had granted a pardon to his son, Hunter Biden, asserting that he has faced unfair prosecution driven by political motivations since Biden took office. He highlighted that such cases typically do not lead to felony charges without aggravating factors and criticized the perceived selective nature of Hunter's treatment. Biden noted that the charges emerged after political opponents pressured the Justice Department, disrupting a negotiated plea deal. He expressed his belief in the justice system but lamented its politicization, stating the pardon was necessary for both a father and a president.

Statement from U.S President Joe Biden

Date: December 01, 2024

Today, I signed a pardon for my son Hunter. From the day I took office, I said I would not interfere with the Justice Departmentโ€™s decision-making, and I kept my word even as I have watched my son being selectively, and unfairly, prosecuted. Without aggravating factors like use in a crime, multiple purchases, or buying a weapon as a straw purchaser, people are almost never brought to trial on felony charges solely for how they filled out a gun form. Those who were late paying their taxes because of serious addictions, but paid them back subsequently with interest and penalties, are typically given non-criminal resolutions. It is clear that Hunter was treated differently.

The charges in his cases came about only after several of my political opponents in Congress instigated them to attack me and oppose my election. Then, a carefully negotiated plea deal, agreed to by the Department of Justice, unraveled in the court room โ€“ with a number of my political opponents in Congress taking credit for bringing political pressure on the process. Had the plea deal held, it would have been a fair, reasonable resolution of Hunterโ€™s cases.

No reasonable person who looks at the facts of Hunterโ€™s cases can reach any other conclusion than Hunter was singled out only because he is my son โ€“ and that is wrong. There has been an effort to break Hunter โ€“ who has been five and a half years sober, even in the face of unrelenting attacks and selective prosecution. In trying to break Hunter, theyโ€™ve tried to break me โ€“ and thereโ€™s no reason to believe it will stop here. Enough is enough.

For my entire career I have followed a simple principle: just tell the American people the truth. Theyโ€™ll be fair-minded. Hereโ€™s the truth: I believe in the justice system, but as I have wrestled with this, I also believe raw politics has infected this process and it led to a miscarriage of justice โ€“ and once I made this decision this weekend, there was no sense in delaying it further. I hope Americans will understand why a father and a President would come to this decision.

Editorial Note

Clemency Requests During Biden’s Administration

The Office of the Pardon Attorney, part of the Justice Department, has received nearly 12,000 requests for clemency during Mr. Bidenโ€™s term. The president has so far issued 157 clemency grants โ€” 25 pardons and 132 commutations โ€” according to a tally kept by the pardon attorney. The Office of the Pardon Attorney assists the President in the exercise of executive clemency. Executive clemency may take several forms, including pardon, commutation of sentence, remission of fine or restitution, and reprieve.

This marks a significant difference when compared to former President Trump’s first administration, where he issued a total of 238 clemency grants โ€” 144 pardons and 94 commutations. As the clemency process continues under the current administration, many are watching to see how these decisions evolve and what implications they may have for justice reform moving forward.
