Preamble
In accordance with paragraph 5.9 of the โWorld Bank Procurement Regulations for
IPF Borrowersโ (July 2016, Revised November 2017 and August 2018) (โProcurement
Regulationsโ) the Bankโs Systematic Tracking and Exchanges in Procurement (STEP)
system will be used to prepare, clear and update Procurement Plans and conduct all
procurement transactions for the Project.
This textual part along with the Procurement Plan tables in STEP constitute the
Procurement Plan for the Project. The following conditions apply to all procurement
activities in the Procurement Plan. The other elements of the Procurement Plan as
required under paragraph 4.4 of the Procurement Regulations are set forth in STEP.
The Bankโs Standard Procurement Documents: shall be used for all contracts
subject to international competitive procurement and those contracts as specified in
the Procurement Plan tables in STEP.

2. Pre-qualification: Not Applicable
3. Reference to Project Procurement Manual: A Procurement Manual based on
World Bank Procurement Regulations for IPF Borrowers, July 2016 shall be
prepared. All procurements in the project will be governed by the procedures
described in the Manual. In case of any inconsistency between the Procurement

Manual and the World Bank Procurement Regulation for IPF Borrower, July 2016 ,
the provisions of the Regulation shall prevail.
4. Any Other Special Procurement Arrangements (Goods & Works) :
A. Contracts procured in advance will be financed under retroactive financing
within the specified limits, as agreed to in the Credit Agreement provided
they are procured in accordance with agreed processes and procedures for
the project and have been cleared as part of procurement plan.
B. National Competitive Bidding (NCB) method for procurement of goods,
works and non-consulting services as per the above value thresholds will be
conducted in accordance with the World Bank Procurement Regulation and
the following provisions:
National Procurement Arrangements: In accordance with paragraph 5.3 of the
Procurement Regulations, when approaching the national market (as specified in the
Procurement Plan tables in STEP), the countryโs own procurement procedures may
be used.When the Borrower uses national open competitive procurement
arrangements it shall be subject to paragraph 5.4 of the Procurement Regulations
and the following conditions:
1) Only the model bidding documents for National Competitive Procurement
(NCP) agreed with the GOI Task Force (and as amended for time to time) shall
be used for bidding.
2) Open advertising of the procurement opportunity will be required, including
giving adequate time for submission of bids.
3) No special preference will be accorded to any bidder either for price or for
other terms and conditions when competing with foreign bidders, state-owned
enterprises, small-scale enterprises or enterprises from any given State.
4) Except with the prior concurrence of the Bank, there shall be no negotiation
of price with the bidders, even with the lowest evaluated bidder.
5) Government e-Marketplace (GeM) set-up by Ministry of Commerce,
Government of India will not be acceptable except for procurement under RFQ
method.
6) At the Borrowerโs request, the Bank may agree to the Borrowerโs use, in whole
or in part, of its electronic procurement system, provided that the Bank is
satisfied with the adequacy of such system.
7) Procurement will be open to eligible firms from any country. This eligibility
shall be as defined under Section III of the Procurement Regulations.
Accordingly, no bidder or potential bidder shall be declared ineligible for
contracts financed by the Bank for reasons other than those provided in Section
III of the Procurement Regulations.
8) The request for bids/request for proposals document shall require that
Bidders/Proposers submitting Bids/Proposals present a signed acceptance (in the
form attached) at the time of bidding, to be incorporated in any resulting
contracts, confirming application of, and compliance with, the Bankโs Anti-
Corruption Guidelines, including without limitation the Bankโs right to sanction
and the Bankโs inspection and audit rights.

9) Procurement Documents include provisions, as agreed with the Bank,
intended to adequately mitigate against environmental, social (including sexual
exploitation and abuse and gender-based violence), health and safety (โESHSโ)
risks and impacts
10) The Borrower shall use an effective mechanism for resolving procurement
related complaints in a timely manner.
When other national procurement arrangements (other than national open
competitive procurement) are applied by the Borrower, such arrangements shall
be subject to paragraph 5.5 of the Procurement Regulations.

estimated to cost the equivalent of US $ 30,000 or more, the qualifications,
experience, terms of reference and terms of employment of the
consultants shall be furnished to the World Bank for its prior review and No
Objection.
