UPON hearing the counsel the Court made the following
O R D E R
1- Issue notice to the original petitioner before the High Court at Calcutta in WPA No 22150 of 2023 and to the State of West Bengal. Notice shall also issue to the Central Bureau of Investigation. Liberty to serve the Standing Counsel for the CBI dasti, in addition.
2- Mr. Kapil Sibal, senior counsel, appears on behalf of the State of West Bengal with Mr Huzefa Ahmadi, senior counsel, and Ms Astha Sharma, Standing Counsel. Ms Astha Sharma accepts notice on behalf of the State of West Bengal.
3- Pending further orders:
(i) There shall be a stay of all proceedings before the Single Judge of the High Court at Calcutta in WPA No 22150 of 2023 and before the Division Bench in MAT No 192 of 2024; and
(ii) The implementation of the directions issued by the Single Judge on 24 and 25 January 2024 shall, in consequence, remain stayed.
4- Mr Kapil Sibal, senior counsel appearing on behalf of the State of West Bengal, states that a Special Leave Petition under Article 136 of the Constitution is being lodged today by the State of West Bengal against the order of the Single Judge dated 25 January 2024.
5-List the Petition on 29 January 2024.
