PART I — Orders and Notifications by the Governor of West Bengal, the High CourtHigh Court High Court Judges in England and Wales handle complex and tough cases, sitting in London and traveling to court centers around the country. They preside over serious criminal and important civil cases, and support the Lord and Lady Justices in hearing appeals. High Court Judges are commonly referred to as ‘Mr/Mrs/Ms Justice surname’ and are given the prefix ‘The Honourable’. They are assigned to the King’s Bench Division, the Family Division, or the Chancery Division. The King’s Bench Division focuses on civil wrongs and judicial review, the Family Division deals with family law, and the Chancery Division handles various cases including company law and probate. Judges are appointed through a rigorous process overseen by the Judicial Appointments Commission., Government Treasury, etc.

In recent years, due to rapid urbanisation and socio-economic developmentDevelopment ανάπτυξη, land prices across the State have risen significantly. Consequently, for lands settled on long-term leases—typically for 30 or 99 years—the renewal fees, calculated on the basis of prevailing market valuation, have become substantial. This has discouraged many lessees from seeking timely renewal of their leases. Such delays adversely affect the revenue interests of the State.

Recognising the need to streamline the renewal process—balancing the State’s revenue considerations with the financial capacity of lessees—the State Government has reviewed the existing framework. In pursuance of section 49 of the West Bengal Land Reforms ActWest Bengal Land Reforms Act WBLR ACT 1955 > Land Transfer Restrictions for Scheduled Tribes in West Bengal under WBLR Act. Requirements for Land Partition in West Bengal (Sec 14 of WBLR Act), 1955 and rule 226 of Chapter XV of the West Bengal Land & Land Reforms Manual, 1991, the Government has considered suitable revisions in the rate of annual rent payable for the renewal of long-term leases of vested lands.

After careful examination, the Governor is pleased to introduce the following amendments to the West Bengal Land & Land Reforms Manual, 1991 (hereinafter referred to as “the said Manual”), specifying the revised annual rent for renewal of long-term leases:

Amendments

In the said Manual, in sub-rule (i) of rule 226—

1. For clause (a), substitute the following:(a)
   • For Industrial, Agri-allied (Poultry, Goatery, Piggery, Duckery, Horticulture, etc.) and Institutional purposes:
     30 times the earlier annual rent or 4% of the current market valuation, whichever is less, shall be the new annual rent for renewal.
   • For CommercialCommercial Profit-making economic activities, such as the production, consumption, exchange, and distribution of goods and services, are primarily undertaken to earn money or a livelihood. Key Features > (1) Involve sale and exchange of goods and services for consideration (money or value), (2) Aim to earn profit and ensure business growth, (3) Include risk-bearing and creation of utility, (4) Economic in nature and satisfy customer needs. Commercial Activities > Earning profit, Business growth, Serving society, Achieving market leadership. purposes:
     50 times the earlier annual rent or 4% of the current market valuation, whichever is less, shall be the new annual rent for renewal.
   Explanation:
   “Institutional use” includes activities carried out by Government Organisations, Parastatals, Government Undertakings, Government-owned companies, and Government-aided educational institutions (excluding private educational institutions).
   It also covers charitable organisations such as Ramakrishna MissionRamakrishna Mission The ideology of Ramakrishna Math and Mission consists of Vedanta principles as 'lived and experienced' by Ramakrishna (Gadadhar Chatterjee, a Sanskrit illiterate deputy priest of Dakhsineswar Kali Temple, a private property of Jamindar Rani Rashmoni) and expounded by Vivekananda (Narendra Nath Dutta). They propagate the Avatarhood of Ramakrishna. They equate Sanatan Dharma with Abrahamic Religion., Bharat Sevashram Sangha, Lions Club, IndianIndia Hind/ hend >hindia. Bharat Varsha (Jambudvipa used in Mahavamsha) is the name of this land mass. The people of this land are Sanatan Dharmin and they always defeated invaders. Indra (10000 yrs) was the oldest deified King of this land. Manu's jurisprudence enlitened this land. Vedas have been the civilizational literature of this land. Guiding principles of this land are : सत्यं वद । धर्मं चर । स्वाध्यायान्मा प्रमदः । The place also been called Hindusthan in Pesia. The word Hendu is mentioned in Avesta. Read more Red Cross Society, Rotary International, and registered clubs/organisations engaged in social welfare activities.
   These categories are illustrative, not exhaustive. In case of any dispute, the State Government’s decision regarding institutional status at the timeTime χρόνος. Judicial: Where any expression of it occurs in any Rules, or any judgment, order or direction, and whenever the doing or not doing of anything at a certain time of the day or night or during a certain part of the day or night has an effect in law, that time is, unless it is otherwise specifically stated, held to be standard time as used in a particular country or state. 2. For clause (b), substitute the following:(b)
   For Homestead or Residential purposes (other than Real Estate development):
   15 times the previously payable annual rent or 4% of the prevailing market price at the time of renewal, whichever is less, shall be the new annual rent for renewal.
3. After clause (b), insert the following:(c)
   For any other purposes:
   50 times the previously payable annual rent or 4% of the market price at the time of renewal, whichever is less, shall be the new annual rent for renewal.
