“An order passed by a competent court- interim or final- has to be obeyed without any reservation. If such order is disobeyed or not complied with, the court may refuse the party violating such order to hear him on meritsMerits Strict legal rights of the parties; a decision โon the meritsโ is one that reaches the right(s) of a party as distinguished from a disposition of the case on a ground not reaching the rights raised in the action; for example, in a criminal case double jeopardy does not apply if charges are nolle prossed before trial commences, and in a civil action res judicata does not apply if a previous action was dismissed on a preliminary motion raising a technicality such as improper service of process.. We are not unmindful of the situation that refusal to hear a party to the proceeding on merits is a “drastic step” and such a serious penalty should not be imposed on him except in grave and extraordinary situations, but sometimes such an action is needed in the larger interest of justiceJustice ฮดฮนฮบฮฑฮนฮฟฯฯฮฝฮท > judicature ( ฮดฮนฮบฮฑฮนฮฟฯฯฮฝฮท) > judge (ฮดฮนฮบฮฑฯฯฮฎฯ / ฮบฯฮนฯฮฎฯ). The whole purpose of Plato`s Republic is to search for Justice. The purpose of Justice is to establish a perfect State. The State of happiness (ฮตฯ ฯฯ ฯฮฏฮฑ) when a party obtaining interim relief intentionally and deliberately flouts such order by not abiding by the terms and conditions on which a relief is granted by the court in his favour.
In the leading case of Hadkinson v. Hadkinson the custody of a child was given to the mother by an interim orderInterim order Once an interim order is passed in a suit or a proceeding, the interim relief granted to the party seeking interim relief could either be confirmed or vacated at the time of final disposal of the suit or proceedings, as the case may be. If the disposal is by way of an order of dismissal, interim relief which is granted as an aid of or ancillary to the final relief cannot continue beyond termination of such suit or proceedings. This is the position of law flowing from the decision in State of Orissa v. Madan Gopal Rungta ( [1952] 1 SCR 28 : (1951) SCC 1024) of the Court, but she was directed not to remove the child out of jurisdictionJurisdiction Authority by which courts receive and decide cases. In spite of the order, the mother removed the child to Australia without prior permission of the Court. On a summonsSummons It means an application to the Court in relation to an action or appeal which has to be served on other parties or nonโparties. by father, the Court directed the mother to return the child within the jurisdiction of the Court. Meanwhile, an appeal was filed by the mother against that order. A preliminary objection was raised by the father that as the appellant was in contempt, she was not entitled to be heard on merits. In an appeal, multiple opinions may be written. The courtโs ruling comes from a majority of judges and forms the majority opinion. A dissenting opinion disagrees with the majority because of the reasoning and/or the principles of law on which the decision is based. A concurring opinion agrees with the end result of the court but offers further comment possibly because they disagree with how the court reached its conclusion. that the mother was not entitled, in view of her continuing contempt of courtContempt of Court Failure to obey a court order.ย A disregard of, or disobedience to, the rules or orders of a judicial body or an interruption of its proceedings by disorderly behavior or insolent language. Civil Contempt:ย Noncompliance with a court order or rule that affects another person; punishment is administered to compel compliance., to prosecute the present appeal and that she will not be entitled to be heard in support of it until she has taken the first and essential step towards purging her contempt of returning the child within the jurisdiction.”
In a concurring judgment, Denning, L.J. also stated: (All ER p.575 C-D) “The present case is a good example of a case where the disobedience of the party impedes the course of justice. So long as this boy remains in Australia, it is impossible for this Court to enforce its orders in respect of him. No good reason is shown why he should not be returned to this country so as to be within the jurisdiction of this Court. He should be returned before counsel is heard on the merits of this case, so that, whatever order is made, this Court will be able to enforce it. I am prepared to accept the view that in the first instance the mother acted in ignorance of the order, but nevertheless, once she came to knowKnowledge Knowledge is derived from the process of an informed person integrating data from sense organs or intuition into their psyche. This concept is explored in the Vedic Nasadiya Sukta, which questions the possibility of ultimate truth or knowledge. In different languages, such as Greek, Latin, Sanskrit, and Chinese, knowledge is expressed as "ฮท ฮณฮฝฯฯฮท," "Scientia," "เคเฅเคเคพเคจเคฎเฅโ ," and "็ฅ่ฏ Zhฤซshรฌ," respectively. of it, she ought to have put the matterMatter Normal matter is made of molecules, which are themselves made of atoms. Inside the atoms, electrons are spinning around the nucleus. The nucleus is made of protons and neutrons. Inside the protons and neutrons, exist indivisible quarks, like the electrons. All matter around us is made of elementary particles. ( building blocks of matter > quarks and leptons). All stable matter in the universe is made from particles that belong to the first-generation. Fundamental forces result from the exchange of force-carrier particles, which belong to a broader group called โbosonsโ. The strong force is carried by the โgluonโ, electromagnetic force is carried by the โphoton.โ right by bringing the boy back. Until the boy is returned, we must decline to hear her appeal.”
That, however, does not mean that in each and every case in which a party has violated an interim order has no right to be heard at all. Nor will the court refuse to hear him in all circumstances. The normal rule is that an application by a party will not be entertained until he has purged himself of the contempt. There are, however, certain exceptions to this rule. One of such exceptions is that the party may appeal with a view to setting aside the order on which his alleged contempt is founded. A person against whom contempt is alleged must be heard in support of the submission that having regard to the meaning and intendment of the order which he is said to have disobeyed, his actions did not constitute a breach of it.
In Gordon v. Gordon, Cozens-Hardy, L.J. put the principle succinctly in the following words ๐ All ER p.706 E-F) “… I desire to limit my judgment to a case in which the [party in contempt is saying] that the order complained of is outside the jurisdiction of the court, as distinguished from the case of an order which, although it is within the jurisdiction of the court, ought not, it is said, to have been made.”
LordLord Adoni in Hebrew (ืึธืืึนื) and dominions in Larin. ฮฌฯฯฮฟฮฝฯฮฑฯ / ฮบฯฯฮนฮฟฯ in NT Denning made the following pertinent observations in Hadkinson: ( All ER pp.574 H-575A) “It is a strong thing for a court to refuse to hear a party to a cause and it is only to be justified by grave considerations of public policy. It is a step which a court will only take when the contempt itself impedes the course of justice and there is no other effective means of securing his compliance.”
There is still one more reason why the appellant Company should be denied equitable relief under Article 136 of the ConstitutionConstitution The Constitution encompasses the global system of rules governing constitutional authority. Simply reading selected provisions of the written text may be misleading. Understanding the underlying principles, such as federalism, democracy, constitutionalism, the rule of law, and respect for minorities, is crucial. Democratic institutions must allow for ongoing discussion and evolution, reflected in the right of participants to initiate constitutional change. This right entails a reciprocal duty to engage in discussions. Democracy involves more than majority rule, existing within the context of other constitutional values. Therefore, a profound understanding of these principles informs our appreciation of constitutional rights and obligations. Read more. According to the respondent Bank, the appellant has not come with clean hands before the Bank. It has suppressed and concealed material facts from the Court.”
