An Ordinance to make provisions in respect of defamation.
WHEREAS it is expedient to make provisions in respect of defamation and for matters connected therewith or incidental thereto;
AND WHEREAS, the President is satisfied that circumstances exist which render it necessary to take immediate action;
NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, and the Provisional ConstitutionConstitution The Constitution encompasses the global system of rules governing constitutional authority. Simply reading selected provisions of the written text may be misleading. Understanding the underlying principles, such as federalism, democracy, constitutionalism, the rule of law, and respect for minorities, is crucial. Democratic institutions must allow for ongoing discussion and evolution, reflected in the right of participants to initiate constitutional change. This right entails a reciprocal duty to engage in discussions. Democracy involves more than majority rule, existing within the context of other constitutional values. Therefore, a profound understanding of these principles informs our appreciation of constitutional rights and obligations. 1. Short title, extent and commencement.โ (1) This Ordinance may be called the Defamation Ordinance, 2002.

2. Definitions.โ In this Ordinance, unless there is anything repugnant in the subject or contextโ

(b) โBroadcastingโ means the dissemination of writings, signs, signals, pictures and sounds of all kinds, including any electronic device, intended to be received by the public either directly or through the medium of relay stations, by means ofโ
(i) a form of wireless radio-electric communication utilizing Hertzian waves, including radio telegraph and radiotelephone, or
(ii) cables, computers, wires, fibre-optic linkages or laser beams, and โbroadcastโ has a corresponding meaning;

(c) โeditorโ means a person or operator having editorial or, equivalent responsibility for the content of the statement or the decision to publish or circulate it;
[5][(cc) โGovernmentโ means Government of the Punjab;]
[6][(d) โnewspaperโ means a paper containing public news, intelligence or occurrences or remarks or observations or containing only, or principally, advertisements, printed for distribution to the public and published periodically, or in parts or numberNumber ฮฯฮนฮธฮผฯฯ, and includes such other periodical works as the Government may, by notification in the officialOffice ฮฮพฮฏฯฮผฮฑ > Officer > Office-bearer (1593) > Opus, officium, ex officio (Latin). [7][(dd) โOriginatorโ means the initiator of the defamatory statement or any other defamatory act;]
(e) โPublicationPublication It includes any speech, writing, broadcast, or other communication in whatever form (including internet and social media), which is addressed to the public at large or any section of the public.โ means the communication of the words to at least one person other than the person defamed and includes a newspaper or broadcast through the internet or other media; and
(f) โPublisherโ means a commercialCommercial Profit-making economic activities, such as the production, consumption, exchange, and distribution of goods and services, are primarily undertaken to earn money or a livelihood. Commercial Activities > Earning profit, Business growth, Serving society, Achieving market leadership. publisher, that is, a person whose business is issuing material to the public, or a section of public, who issues material containing the statement in the course of that business.
3. Defamation.โ (1) Any wrongful act or publication or circulation of a false statement or representation made orally or in written or visual form which injures the reputation of a person, tends to lower him in the estimation of others or tends to reduce him to ridicule, unjust criticism, dislike, contempt or hatred shall be actionable as defamation.
(2) Defamation is of two forms, namely:โ
(i) Slander; and
(ii) Libel.
(3) Any false oral statement or representation that amounts to defamation shall be actionable as slander.
(4) Any false written, documentary or visual statement or representation made either by ordinary form or expression or by electronic or other modern means of devices that amounts to defamation shall be actionable as libel.
4. Defamation Actionable.โ The publication of defamatory matterMatter Normal matter is made of molecules, which are themselves made of atoms. Inside the atoms, electrons are spinning around the nucleus. The nucleus is made of protons and neutrons. Inside the protons and neutrons, exist indivisible quarks, like the electrons. All matter around us is made of elementary particles. ( building blocks of matter > quarks and leptons). All stable matter in the universe is made from particles that belong to the first-generation. Fundamental forces result from the exchange of force-carrier particles, which belong to a broader group called โbosonsโ. The strong force is carried by the โgluonโ, electromagnetic force is carried by the โphoton.โ is an actionable wrong with out proofProof Mathematical proof, Direct proof, Proof by contraposition, Proof by contradiction, Proof by construction, Proof by exhaustion, Closed chain inference, Probabilistic proof, Combinatorial proof, Nonconstructive proof, Computer-assisted proofs. of special damage to the person defamed and where defamation is provedProved A fact is said to be proved when, after considering the matters before it, the Court either believes it to exist, or considers its existence so probable that a prudent man ought, under the circumstances of the particular case, to act upon the supposition that it exists;, damage shall be presumed.
5. Defences.โ In defamation proceedings a person has a defence if he shows thatโ
(a) he was not the author, editor, publisher or printer of the statement complained of;
(b) the matter commented on is fair and in the public interest and is an expression of opinionOpinion A judge's written explanation of a decision of the court. In an appeal, multiple opinions may be written. The courtโs ruling comes from a majority of judges and forms the majority opinion. A dissenting opinion disagrees with the majority because of the reasoning and/or the principles of law on which the decision is based. A concurring opinion agrees with the end result of the court but offers further comment possibly because they disagree with how the court reached its conclusion. and not an assertion of factFact Something เคคเคฅเฅเคฏ (In-formation) that truly exists or happens or some-thing that has actual existence. Circumstances: a fact or event that makes a situation the way it is. Indian Evidence Act:ย It means and includesโ (i) anything, state of things, or relation of things, capable of being perceived by the senses; (ii) any mental condition of which any person is conscious. โfacts in issueโ means and includes any fact from which, either by itself or in connection with other facts, the existence, non-existence, nature or extent of any right, liability or disability, asserted or denied in any suit or proceeding, necessarily follows. and was published in good faithFaith ย ฯฮฏฯฯฮตฮน.;
(c) it is based on truthTruth Mathematical 'truth' may not be agreeable with the philosophical 'truth.' A question may be asked on propositional 'truth' on the grounds of physics, that space and time actually don't exist. Vedic injunction Satyam Param Dhimahi, technically Satya is none other than Brahman. For Madhymic Buddhists there is nothing as such to be called 'truth', as all the corresponding facts are only mental projections. Apart from Bio-neuroelectricity nothing exists for Biological Cognition. So-called religious truths are nothing more than a marketing strategy. and was made for the public good;
(d) assent was given for the publication by the plaintiff;
(e) offer to tender a proper apologyApology Whether solemn or formal or public or private, expressing soulful regret for known/unknown mistake, error, lowering the prestige or insult, given in written form or orally. Christian apologists (apologetics) defend the Christian faith and its validity. > after the Gospel no need of research."--Tertullian, Prescription of Heretics. and publish the same was made by the defendant but was refused by the plaintiff;
(f) an offer to print or publish a contradiction or denial in the same manner and with the same prominence was made but was refused by the plaintiff;
(g) the matter complained of was privileged communication such as between lawyer and client or between persons having fiduciary relations; and
(h) the matter is converted by absolute or qualified privilege.
6. Absolute privilege.โ Any publication of statement made in the Federal or Provincial Legislatures, reports, papers, notes and proceedings ordered to be published by either House of the Parliament or by the Provincial Assemblies, or relating to judicial proceedings ordered to be published by the court or any report, note or matter written or published by or under the authority of Government, shall have the protection of absolute privilege.
Explanation.โ In this section legislature includes a local legislature and Court includes any Tribunal or body exercising the judicial powers.
7. Qualified privilege.โ Any fair and accurate publication of parliamentary proceedings, or judicial proceedings which the public may attend and statements made to the proper authorities in order to procure the redress of public grievances shall have the protection of qualified privilege.
8. Notice of Action.โ No action lies unless the plaintiff has, within two months after the publication of the defamatory matter has come to his notice or knowledgeKnowledge Knowledge is derived from the process of an informed person integrating data from sense organs or intuition into their psyche. This concept is explored in the Vedic Nasadiya Sukta, which questions the possibility of ultimate truth or knowledge. In different languages, such as Greek, Latin, Sanskrit, and Chinese, knowledge is expressed as "ฮท ฮณฮฝฯฯฮท," "Scientia," "เคเฅเคเคพเคจเคฎเฅโ ," and "็ฅ่ฏ Zhฤซshรฌ," respectively., given to the defendant, fourteen days notice in writing of his intentionIntention This means to โhave in mind.โ A plant to do a thing (Planning: premeditation is evident through evidence of active preparation, e.g., hoarding pills, purchase of weapon). It refers to the aim, purpose, or goal of the behavior, e.g., to seek an end to/solution. A consciousย mental processย to move precedes the brainโs preparation for movement. to bring an action, specifying the defamatory matter complained of.
9. Remedies.โ Where defamation shall be proved to have occurred, the Court may pass order directing the defendant to tender an apology, if acceptable to the plaintiff, and publish the same in similar manner and with the same prominence as the defamatory statement made and pay reasonable compensatory damagesDamages Damages (often termed โuser damageโ) are readily awarded at common law for the invasion of rights to tangible moveable or immovable property (by detinue, conversion or trespass). Damages are also available on a similar basis for patent infringement and breaches of other intellectual property rights of a proprietary character. as general damages with a minimum of Rs.50,000/- (Rupees fifty thousands) [8][* * *] and in addition thereto, any special damage incurred that is proved by the plaintiff to the satisfaction of the Court[9][:]
[10][Provided that in case of the originator the minimum compensatory damages as general damages shall be three hundred thousand rupees.]
10. Code of Civil Procedure and Qanun-e-Shahadat Order to Apply.โ The Code of Civil Procedure, 1908 (V of 1908) and the Qanun-e-Shahadat Order, 1984 (P.O. No.10 of 1984) shall mutatis mutandisMutatis mutandis It means "with necessary changes in the points of detail" or "with such change as may be necessary", apply to the proceedings under this Ordinance.
11. Ordinance not to prejudice action for criminal defamation.โ Nothing in this Ordinance shall prejudice any action for criminal libel or slander under any lawLaw ฮฝฯฮผฮฟฯ:ย Positive command of sovereign or divine. 12. Limitation of actions.โ An action againstโ
(a) an author, editor, proprietor or publisher of a newspaper,
(b) the owner of a broadcasting station,
(c) an officer, servant or employee of the news paper or broadcasting station; or
(d) any other person;
for defamation contained in the newspaper or broadcast from the station or its publication otherwise shall be taken within six months after the publication of the defamatory matter came to the notice or knowledge of the person defamed.
[11][13. Trial of Cases.โ The District Court shall have the jurisdictionJurisdiction Authority by which courts receive and decide cases. 14. Court to decide the cases expeditiously.โ The Court shall decide a case under this Ordinance within a period of [12][ninety days].

Appeal.โ An appeal against the final decision and decree of the Court shall lie to the High CourtHigh Court High Court Judges in England and Wales handle complex and tough cases, sitting in London and traveling to court centers around the country. They preside over serious criminal and important civil cases, and support the Lord and Lady Justices in hearing appeals. High Court Judges are commonly referred to as โMr/Mrs/Ms Justice surnameโ and are given the prefix โThe Honourableโ. They are assigned to the Kingโs Bench Division, the Family Division, or the Chancery Division. The Kingโs Bench Division focuses on civil wrongs and judicial review, the Family Division deals with family law, and the Chancery Division handles various cases including company law and probate. Judges are appointed through a rigorous process overseen by the Judicial Appointments Commission. within thirty days and the High Court shall decide the appeal within sixty days:
Provided that no appeal shall lie against an interlocutory order of the Court.]
16. Power to make rules.โ The [14][* * *] Government may, by notification in the official Gazette, make rules to carry out the purpose of this Ordinance.
