Delay in Despatch of FIR to Magistrat

(i) Mere delay in Despatch of FIR to magistrate is not a circumstance, which can throw out the prosecution case entirely. [Pala Singh & vs. State of Punjab, AIRAIR All India Reporter 1992 SC 2679]

(ii) The delay is not necessarily fatal particularly when it has been recorded without delay and no suspicion is attached to its recording. [State of MP vs. Gokaran, AIR 1966AIR SC 131]

(iii) Delay in sending FIR to Magistrate forthwithForthwith In Rao Mahmood Ahmad Khan v. Ranbir Singh , has held that the word ‘forthwith’ is synonymous with the word immediately, which means with all reasonable quickness. When a statute requires something to be done ‘forthwith’ or ‘immediately’ or even ‘instantly’, it should probably be understood as allowing a reasonable time for doing it. The interpretation of the word ‘forthwith’ would depend upon the terrain in which it travels and would take its colour depending upon the prevailing circumstances which can be variable. State of Delhi [1955] 1 SCR 1150 : (1954) 2 SCC 934; Sk. Salim v. State of West Bengal [1975] 3 SCR 394 : (1975) 1 SCC 653; China Apparao and Others v. State of Andhra Pradesh [2002] Supp. 3 SCR 175 : (2002) 8 SCC 440; Navalshankar Ishwarlal Dave v. State of Gujarat [1993] 3 SCR 676 : 1993 Supp. 3 SCC 754; Rao Mahmood Ahmad Khan v. Ranbir Singh [1995] 2 SCR 230 : (1995) Supp. 4 SCC 275; Bidya Deb Barma v. District Magistrate [1969] 1 SCR 562 : (1968) SCC OnLine SC 82.  gives rise to the suspicion that the report was recorded much latter than the stated date. Obviously delay needs to be explained satisfactorily. [IshwarIshwar ईश्वर (ई+श्वर) ईश. ईशावास्योपनिषत् (तदेजति तन्नैजति तद्दूरे तद्वन्तिके॥ तदन्तरस्य सर्वस्य तदु सर्वस्यास्य वाह्यतः). Biblical God is not ईश्वर. क्लेश कर्म विपाकाशयैर् अपरामृष्टः पुरुष विशेष ईश्वरः.  Om (प्रणव) is the signature of  Ishwar (Patanjali).पूर्वेषाम् अपि गुरुः कालेनानवच्छेदात्  (तत्र निरतिशयं सर्वज्ञ बीजम्). Vedic Devatas are physical Energy of ईश्वर. They exist for fulfilling  the purpose of Yagna. स भगवान् ज्ञानैश्वर्यशक्तिबलवीर्यतेजोभिः सदा सम्पन्नः। ईश्वरे “ईशावास्यमिदं सर्वम्” यजु० ४०, १, “नमो देवेभ्यो नम ईश एषां कृतं चिदेनोमनमा विवासे” ऋ० ६, ४१, ८ । “स देवानामीशां पर्य्येतु स ईशानोऽभवत्” अथ० १५, १, ५ । “सह एवेशामारण्यानां पशूनामवरुन्धे” शत० ब्रा० १२, ७, २, ८ । See God Singh vs. State of UP, AIR 1976 SC 2423]
