MEMORANDUM

Subject: Revision of Pension / Family Pension, Medical Allowance, Domestic Help Allowance of the Judicial Officers of the State who retired prior to 01.01.2006 as per recommendations of Justice Padmanabhan Committee which has been accepted by the Hon’ble Supreme Court of India with some modifications by the order dated 26.7.2010 and 02.08.2010 in 1A No. 244 in writ petition (Civil) No. 1022 of 1989 (All India Judges Association & Ors.-V-Union of India & Ors.)

The undersigned is directed to refer to the above noted subject and to state that the Governor, after careful consideration of the matter, has been pleased to decide that the retirement benefits in respect of the State Judicial Officers, irrespective of their ranks, who retired prior to 01.01.2006 shall be determined as under:

2- (i) The revised pension of the Judicial Officers who retired prior to 01.01.2006 shall be 50% of the minimum pay of the revised pay scale of the post held by him at the time of the retirement as shown in the Table below :

(ii) There shall not be any ceiling limit on the maximum pension benefit.

(iii) The Dearness Relief shall be at the rates as are applicable to the serving Judicial Officers at Central Government rate.

(iv) The Family Pension shall be revised and re-fixed at 30% of the minimum pay of the pay scale of the post held by the pensioner at the time of the retirement in the revised pay scales given in the above Table.

(v) The Judicial Officers who retired prior to 01.01.06 and the Family Pensioner shall also be entitled to Domestic Help allowance @ Rs. 2,500/- and Rs. 1,000/- per mensem respectively.

(vi)The Judicial Officers who retired prior to 1.1.06 and the family pensioners shall also be entitled to Medical Allowance @ Rs. 1,500/- and Rs. 750/- per mensem respectively to meet their day to day medical expenses in addition to other medical facilities with regard to treatment and medical expenditure as per memo no. 10771-F dated 29th November, 2004.

(vii) In addition to the pension/family pension calculated in para (i) and para (iv) above, the quantum of pension/family pension available to the old family pensioners shall be increased as indicated in the following table w.e.f., 1.1.2006 :

3- The revision in pension shall come into effect from 1.1.2006 and will be applicable to the Judicial Officers who have retired or ceased to be in service due to death prior to 1.1.2006.

4- In respect of all the retired Judicial Officers and Family Pensioners all the Treasury Officers / Other Pension Payment Authorities like Bank shall revise and re-fix the pensions and Family Pensions sanctioned in this order on receipt of necessary certificate in this regard from the Pension Sanctioning Authority and after making necessary entries in the Pension Payment Orders make payments to the retired Judicial Officers and Family Pensioners without awaiting further authorization/instructions from the Accountant General (A&E), West Bengal. The Pension Sanctioning Authority shall, on the application of pre-2006 pensioner/family pensioner issue certificate stating the pay scale of the post held by the pensioner at the time of his/her retirement. The revised pension together with dearness relief and other allowance shall be paid in cash w.e.f. 1.1.2006 by 31.3.2011.

5- In the event of death of pensioners or Family Pensioners the arrears of Revised Pensions and Family Pensions together with Dearness Relief shall be paid to his or her nominee(s) and if there is no nomination to his/her legal heirs.

6-This order issues with the concurrence of the Finance (audit) Department vide their U.O. No. 3255 Group-P (Service) dated 21.10.2010.
