Rules on rights of lawyers in the proceedings before the Supreme Court of Iceland

 In order to bring an appealed civil case before the Supreme Court, a lawyer must have the right to litigate before the Supreme Court. The same rights are required to be appointed in a criminal case as a defense counsel or a legal guardian or to bring the case of the accused or victim before the court.

RULES on the rights of lawyers in the proceedings before the Supreme Court of Iceland

Article 1

   In order to bring an appealed civil case before the Supreme Court, a lawyer must have the right to litigate before the Supreme Court. The same rights are required to be appointed in a criminal case as a defense counsel or a legal guardian or to bring the case of the accused or victim before the court.
    

A lawyer who has the right to litigate in district courts and has been granted rights according to Art. Paragraph 2 Article 9 Act no. 61/1942 on litigants may appeal a civil case before the Supreme Court and obtain an appointment in a criminal case as a defense counsel or legal guardian or to bring the case of the accused or victim before the court.

The authorization of a lawyer in another state in the European Economic Area to bring a case before a court is subject to the third paragraph. Article 2 Act no. 77/1998 on lawyers.

Article 2

    To appeal the ruling of the National Court in a civil case to the Supreme Court and submit a statement regarding an appeal in a civil case, as is required according to the second paragraph. Article 171 Act no. 91/1991 on civil proceedings, a lawyer must have the right to litigate before the Supreme Court.

    In criminal cases, a lawyer who has been appointed a defense counsel or a legal guardian before the National Court may appeal the ruling of the National Court to the Supreme Court as well as submit a statement to the court regarding the appeal.

Article 4

    A lawyer who submits a complaint or statement must sign it himself.

Article 5

    A lawyer who has the right to litigate before the National Court can apply for leave to appeal to the Supreme Court and respond to a request for such leave.
    A lawyer who has the right to litigate in district courts can apply for permission from the Supreme Court to appeal the judgment of the district court to the court and respond to a request for such permission.

 These rules were approved by the judges of the Supreme Court of Iceland on 15 October 2018.
